Hi everyone...

I was thinking of opening a free hosting company myself, and I was wondering if anyone has had any legal threats due to clients creating phishing pages, or hosting copyrighted software on your servers.

The only problem you can run into is the server company shutting off your server because of complaints to their abuse deptartment. But ususally if a company contacts you directly about a phising site they are very nice about it. They just ask that you remove the site, reply with any info you have on the scammer, and to watch your sites more closely. I have never had a threat, just a nice email asking me to remove the site.

I agree with DKM. For the most part I have been fortunate. Everymonth you have a few kids trying to upgrade their packages or get root on your system, sometimes buy exploiting cpanel and such. So secure your servers, have a strict TOS and you will be fine!

i have cogent turn off my lines and blacklist my network due to phishing sites, took 2 hours with abuse manager to get it back on

i have since left cogent, its rubbish bandwith anyway.

Cogent is bad anyways. And that is your fault for letting people phish, as an administrator you really have to be carefull. Do daily scans of your system for common things like .torrents, common cgi/phpmailers... so forth.
